Please read the following terms and conditions carefully before placing your order with Stone Dog Meadery Pty Ltd. When you complete the customer application process and use the services provided by Stone Dog Meadery Pty Ltd, you acknowledge that you have read and understood these terms and conditions, and agree to be bound by the terms and conditions of this Agreement.
In these Terms & Conditions, Stone Dog Meadery Pty Ltd will be referred to as Stone Dog Meadery.
1. Glossary of Terms
“Agreement” means an agreement between the customer, you, and Stone Dog Meadery to supply Goods.
“Conditions” means these Conditions and any agreed written variations.
“Delivery Address” means the address to which the Goods are to be delivered as stated on the Order.
“Goods” means Goods described in an Order and includes packaging.
“Intellectual Property Rights” includes all rights in respect of copyright, trademarks, patents, designs, protection of confidential information, and any other intellectual or industrial property rights whether arising under statute or otherwise.
“Order” means an order by you to purchase Goods from Stone Dog Meadery.
“Personal Details” includes, but is not limited to Your name, Delivery Address and payment details. Please see our Privacy Policy for further information on how your information is treated.\
“Product List” means the list of Goods as displayed on the Stone Dog Meadery website. The Product list is amended from time to time.
“Shipping” means the fees payable to Stone Dog Meadery in respect of delivery of the Goods and handling costs associated with processing the Order as advised by Stone Dog Meadery from time to time.
“Assigns” means a party acting on behalf of Stone Dog Meadery (ie: Australia Post or Couriers).
2. The Agreement
The whole Agreement between you and Stone Dog Meadery for the purchase of Goods by you from Stone Dog Meadery is inclusive of both these conditions and the terms of the order. Each Order is a separate agreement. The agreement exists between you and Stone Dog Meadery once Stone Dog Meadery receives and accepts your order. Each order may be accepted by Stone Dog Meadery in its absolute discretion.
3. Purchase orders & delivery of goods
3.1 Delivery Area
In order to purchase Goods from Stone Dog Meadery, the Delivery Address which you nominate will need to be within a location where Stone Dog Meadery provides delivery services. Stone Dog Meadery will advise you if the Delivery Address which you nominate is not in an area where Stone Dog Meadery delivers goods. Stone Dog Meadery will not be obliged to continue to deliver Goods to you if you change your Delivery Address and the new Delivery Address which you nominate is not in an area within which Stone Dog Meadery delivers goods.
3.2 Orders
You place an Order with Stone Dog Meadery by:
a. Selecting Goods on the Stone Dog Meadery website, entering your Personal Details and pressing the “submit” or similar button; or
b. Selecting Goods and instructing Stone Dog Meadery by telephone that you wish to purchase the Goods, and providing your Personal Details to Stone Dog Meadery; or
c. Selecting Goods and instructing Stone Dog Meadery by e-mail that you wish to purchase the Goods, and providing your Personal Details to Stone Dog Meadery; or
3.3 Authorized Receipt of Goods
Anyone at the Delivery Address who receives the Goods shall be presumed by Stone Dog Meadery and its Assigns to be authorized to receive the Goods on your behalf. Stone Dog Meadery and its Assigns may request that the person who receives the Goods at the Delivery Address provide satisfactory evidence of proof of age. Stone Dog Meadery and its Assigns will refuse to deliver the Goods if the person receiving the Goods is unable or unwilling to provide evidence of proof of age. The Goods will not be delivered to persons under the age of eighteen (18) years or to persons who fail to provide proof of age satisfactory to Stone Dog Meadery and its Assigns that the person is aged eighteen (18) years or over.
3.4 Delivery Requirements
Stone Dog Meadery is required by law to give written instructions to the person responsible for delivery of the liquor, requiring that the liquor be delivered: (a) to the adult person who placed the Order, or (b) to another adult person at those premises who undertakes to accept it on your behalf, or (c) if delivery takes place on a day following the placing of an Order, in accordance with the customer’s instructions but always to a person over the age of 18 years .The person responsible for delivering liquor may refuse to deliver the liquor to any person who fails to provide proof of age satisfactory to the person responsible that the person is aged eighteen (18) years or over.
3.5 Additional Delivery Information
If there is no-one at the Delivery Address, or no-one of appropriate age to receive the Order, Australia Post will leave a card advising you of the address at which you may collect your parcel.

5. Price of Goods and Payment
5.1 Price of Goods
Subject to clause 5.2 below, the price you pay for the Goods is the price specified on the Product List/Website at time that Goods are confirmed as ordered. You must also agree to pay any delivery fee (if applicable) as well as GST and WET taxes, which Stone Dog Meadery is required to collect by law, and which are included in the specified price. All prices quoted are in Australia dollars, “AUD”.
5.2 Prices subject to change
Stone Dog Meadery prices are subject to change without notice. The price you pay for your ordered Goods will be the price applicable on the date of your confirmed order.
5.3 Method of Payment
Payment is payable upon placement of Order, and must be paid in full prior to dispatch thereof. Payments are accepted by credit card (Bankcard, MasterCard and Visa), Paypal, or direct deposit to our bank account. Bank details will be provided on our invoice.

6. Out of stock & substitutions
6.1 Substitution Policy
Due to the nature of our products, Stone Dog Meadery may at some time sell out of an item you have ordered. Stone Dog Meadery will contact you to discuss possible substitutions if your selections are not readily available in stock due to a sell out or other unforeseen circumstances.
6.2 No Rainchecks or “reservations” on stock
Stone Dog Meadery will not provide rainchecks or undertake a reservation system.
7. Packing and Labelling of Goods
Due to the variable nature of our products, Stone Dog Meadery does not guarantee the accuracy of information on the Product List. It is recommends that you read the label on Goods carefully before consuming the Goods.
8. Intellectual Property Rights
You acknowledge that Stone Dog Meadery is licensed to use all Intellectual Property Rights regarding our Stone Dog Meadery website, including, but not limited to: images, photographs or text. You agree that you accept this, and must not use or copy anything found on the site with the permission of Stone Dog Meadery as the owner and license holder of these rights
9. Liability limitations
You acknowledge that Stone Dog Meadery produces beverages containing alcohol. Therefore, you understand that Stone Dog Meadery will not be held responsible for your actions under the influence thereof.
To the extent permitted by law, you agree that any liability of Stone Dog Meadery offers no implied warranty or condition in respect of goods or services supplied to you through use of our website, If you are not satisfied with our product, please consult the Returns Policy available on the Stone Dog Meadery website.
If the condition of the goods as they arrive to you are unsatisfactory, please consult the Returns Policy available on the Stone Dog Meadery website.
You agree that any risk of your use of Stone Dog Meadery’s website is entirely your own. You release and discharge Stone Dog Meadery from all forms of direct, special, indirect or consequential loss or damage (including loss of profits, loss of data or loss or damage that may reasonably have been supposed to have been in the contemplation of the parties as at the date of this Agreement) arising out of or in connection with Stone Dog Meadery or this Agreement, including, without limitation, loss or damage caused by the negligence of Stone Dog Meadery.
10. Changes may occur without notice
Stone Dog Meadery may add, delete, edit or otherwise change any of the terms of this Agreement without notice other than posting an updated copy to our website.
11. Notices and other communications
Stone Dog Meadery may give notices or other communication to you by e-mail or by regular mail to your address contained in the registration information provided by you. You may opt out of receiving these notices at any time by contacting us with your details to be removed from the mailing list. Stone Dog Meadery will not share thier mailing list with third parties.
12. Provisions are severable
Each provision of this Agreement, in its entirety, are severable. Severance of any particular item does not affect any other provisions or the Agreement as a whole.
13. New South Wales Law
The laws of New South Wales govern this Agreement, and are upheld.
14. Office of Liquor, Gaming & Racing (OLGR)
The regulations of the OLGR are also upheld in full force.
